TERMS AND CONDITIONS FOR THE PROVISION OF TRAINING SERVICES

(ON-SITE AND ONLINE)

 

§1 Definitions:

1. Training organizer (stationary and online): ani beee, ani meee - Małgorzata Gancarz with its registered office at ul. Pallotyńska 1, 27-600 Sandomierz, NIP: 8641966769, REGON: 527655368

2. Training hour: 60 calendar minutes.

3. Ordering party: an adult natural or legal person who has completed the application form for a given training course.

4. Participant: a person qualified to participate in the training after receiving confirmation from the Organizer.

5. Training program (Program):  the order of activities to be performed, including effective measures for the efficient implementation of training.

6. Participant Account: assigned to the Participant, enabling access to the Closed Zone of Specialized Materials of the e-learning platform.

7. Agreement for the Provision of Training Services (Agreement): a civil law agreement whose subject matter is the provision of Training Services.

 

 

§2 Stationary training courses:

1. The organizer offers stationary training courses and workshops on the dates specified in the current training offer available at www.maleprzezuwacze.edu.pl, under the EDUCATIONAL OFFER tab.

2. Stationary training courses and workshops are organized for groups of at least 10 people. The Organizer reserves the right to change the date of the training course if the minimum number of participants is not reached on a given date.

3. The number of places on the training courses is limited, and participation is determined by the order of registration, confirmed by signing the Agreement and paying the fee.

4. The organizer reserves the right to make minor changes to the program during the training due to the selection of participants who have registered for the training.

5. Participants enrolled in the training will receive confirmation of the training by email, no later than 7 working days before the start date.

6. All registered Participants will be notified of any changes to the training date by email, no later than 7 days before the start of the training.

 

§3 Online training:

1. The Organizer offers courses, training sessions, webinars, and online video tutorials on the dates specified in the current offer, available at www.maleprzezuwacze.edu.pl, under the EDUCATIONAL OFFER tab.

2. The number of places on the training courses is limited, and participation is determined by the order of registration, confirmed by signing the Agreement and paying the fee.

3. The Organizer reserves the right to make minor changes to the program during the training due to the selection of Participants who have registered for the training.

4. Participants enrolled in the training will receive confirmation of the training by email no later than 7 working days before the start date.

5. All enrolled Participants will be notified of any changes to the training date by email no later than 7 days before the start date of the training.

 

§4 Registration for classroom and online training:

1. Registration for training takes place by:

a) completing the appropriate Registration Form provided for the training course on the website www.maleprzezuwacze.edu.pl and making a payment directly to the account number received in the e-mail.

b) selecting the product in the Online Store and paying the training fee.

2. Applications are accepted up to 14 days before the start of the training. After this date, participation is only possible after confirmation by email from the Organizer, depending on availability.

3. After receiving the Application Form, the Organizer will send a confirmation by email. Submitting the form is tantamount to a commitment to pay for the training.

4. An e-learning platform is available to participants of training courses, classes, and video tutorials: Closed Training Zone (only if the Organizer provides for its use as part of a given training course, class, or video tutorial).

5. In order to use the Closed Training Zone, it is necessary to register the Participant on the e-learning portal. Registration takes place automatically using the data provided in the Application Form, i.e., first name, last name, and email address.

6. The Participant logs into the Account using their own email address and a generated password sent to their email address by the Organizer.

7. The Participant may delete their Account at any time, without giving any reason and without incurring any fees, by sending a request to the Organizer via email.

 

§5 Withdrawal from participation in classroom training and termination of the agreement

1. Withdrawal from participation in training should be reported by email to kontakt@maleprzezuwacze.edu.pl. In the event of withdrawal from participation in training:

a) More than 60 working days before the start date of the training, withdrawal is associated with a refund of 60% of the costs incurred by the Participant.

b) Between 60 and 31 days before the start date of the training, withdrawal is associated with a refund of 50% of the costs incurred by the Participant.

c) 30 days or less before the start date of the training, the costs incurred by the Participant are not refundable.

2. Absence from the training (without formal notification of cancellation) does not release the Participant from the obligation to pay for the training.

3. If unable to participate, the applicant may designate another Participant to take their place, for whom they assume full responsibility. 

4. Apart from the cases specified in the applicable provisions of law, the Service Provider may terminate the agreement with immediate effect in the event of:

a) Delay by the Ordering Party/Course Participant in paying the due remuneration.

b) Violation by the Ordering Party/Participant of the provisions of the regulations or the agreement.

 

§6 Withdrawal from participation in online training and termination of the agreement

1. Withdrawal from participation in the training should be reported by email to kontakt@maleprzezuwacze.edu.pl. In the event of withdrawal from participation in the training:

a) More than 30 working days before the start date of the training, withdrawal is associated with a refund of 60% of the costs incurred by the Participant.

b) Between 30 and 11 days before the start date of the training, withdrawal is associated with a refund of 50% of the costs incurred by the Participant.

c) 10 days or less before the start date of the training, it is not possible to refund the costs incurred by the Participant. The Participant may attend the training on another date.

2. Absence from the training (without formal notification of cancellation) does not release the Participant from the obligation to pay for the training.

3. If unable to attend, the applicant may designate another Participant to take their place, for whom they take full responsibility. 

4. Apart from cases specified in applicable law, the Service Provider may terminate the agreement with immediate effect in the event of:

a) Delay by the Ordering Party/Course Participant in payment of the due remuneration.

b) Violation by the Ordering Party/Participant of the provisions of the regulations or agreement.

 

§7 Cancellation of training (in-person and online), change of date, other unforeseen circumstances

1. The Organizer reserves the right to cancel the training at any time without giving a reason. The Organizer will inform each registered participant by email of the new training date, which requires written acceptance. If the new date is not accepted within 14 days of notification of the cancellation of the training, the Organizer will refund the fees paid by the Participants by bank transfer to the Participant's bank account. 

2. The Organizer reserves the right to change the venue of the training (stationary training) in the event of unavailability or a situation that hinders its conduct. 

3. The Organizer reserves the right to make changes to the training. In particular, changes may concern: the duration and hours of training.

4. Information about the above circumstances may be provided no later than 7 days before the planned change takes place. 

5. The Organizer shall not be liable for any costs or lost benefits arising in connection with the changes referred to in section 1 of this paragraph.

 

§8 Training program (in-person and online), price, and payment terms:

1. The training is conducted in accordance with the current program, available on the website www.maleprzezuwacze.edu.pl, under the tab EDUCATIONAL OFFER.

2. The price of the training includes:

a) the cost of conducting the training,

b) training materials (only if they are an integral part of the training),

c) a personalized certificate (in paper form or as a .pdf file)

d) the cost of meals (coffee service, lunch) - unless the training description states otherwise (e.g., it is an online training).

The price does not include: any accommodation, travel, or parking costs. 

3. Payments should be made after receiving an email from the Organizer confirming acceptance to the following bank account number:

In the title: date and title of the training and the participant's first and last name

4. The Organizer reserves the right to conduct limited-time promotional campaigns involving changes to the Price List available on the website. Changes to the Price List, including in particular reductions in the fees for participation in training courses, shall not constitute grounds for withdrawing from previously concluded Agreements or for demanding a reduction in the fees for participation in training courses resulting from those Agreements.

 

§9 Online training:

1. The website www.maleprzezuwacze.edu.pl also serves as an e-learning platform containing detailed information about current training courses. Broadcasts are conducted via applications or platforms specified directly by the Organizer.

2. In order to use the online training services, the Participant must have a device (laptop, desktop computer) connected to the Internet with one of the following web browsers: Google Chrome, Mozilla, Firefox, Internet Explorer. Detailed technical requirements are provided by email after registration for the training.

3. The Organizer is not responsible for mail server administrators blocking messages sent to the email address provided by the Ordering Party/Training Participant in the registration form (order), or for the removal and/or blocking of electronic messages by software installed on electronic equipment used by the Ordering Party/Training Participant. Training Participant.

4. After successful registration and payment for the training, the Participant has the right to participate by accessing the e-learning platform or application indicated by the Organizer.

5. The Participant has the right to ask questions during the training using a dedicated tool indicated by the Organizer.

6. The training participant has the right to access the Closed Training Zone after registering and paying for the training, provided that this is stated in the description of the training service.

7. In order to use the additional materials posted in the above-mentioned Closed Training Zone, a Participant Account with an automatically generated password will be assigned to the Participant's e-mail address. The login details will be provided by the Organizer in an e-mail. 

8. The additional materials posted in the Closed Training Zone are specialized materials mainly in Polish and English. Materials in Spanish may also be made available to Participants - in such a case, they will be translated into Polish.

9. Unless otherwise specified in the Program, upon completion of a given training, course, or video tutorial, access to the Closed Zone of Specialized Materials will end, and all Participants' Accounts will be automatically deleted. However, the Participant may still receive emails from the maleprzezuwacze.edu.pl domain, in accordance with their consent to receive the Newsletter (see: Privacy and Cookies Policy, VI. Data retention period).

10. The Ordering Party or Participant may not transfer the rights and obligations arising from the agreement to a third party without the prior written consent of the Organizer, under pain of nullity.

11. The data provided in the training application form are also used for invoicing purposes.

 

§10 Copyright and consent to use image:

1. The Participant and the Ordering Party acknowledge that all rights to the training materials are vested in the Organizer or its Licensors; this reservation also applies to the development of the original work within the meaning of copyright law.

2. The Participant and the Ordering Party are obliged not to use in any way, in particular during organized training courses, training materials to which the Organizer or its Licensor holds the rights. Neither the Participant nor the Ordering Party has the right to make copies of training materials using any technique or to transfer them in electronic form. 

3. The Organizer shall not be liable for any damage resulting from the misuse of the services and/or materials offered. 

4. It is prohibited to record or bring in equipment that enables the recording of audio or video training sessions.

5. The content of the training materials is protected by copyright (Act of February 4, 1994 on copyright and related rights (Journal of Laws of 2000, No. 80, item 904, as amended Amendments)), and their reproduction, dissemination, modification, translation into foreign languages, or any distribution is prohibited.

6. If, during the course, training, or online video tutorial, a connection is made with the Participant in such a way that their image, opinions, statements, presentations, etc. become part of the webinar (and have the characteristics of an independent work), this is tantamount to the Participant, by registering for the online training:

a) consents to the recording and publication of their image or work, 

b) consents to the merging of these works with the content of the online training (collective work), 

c) grants the Organizer a free, perpetual license to use the above-mentioned works.

7. In accordance with the provisions of the Act on Copyright and Related Rights of February 4, 1994 (Journal of Laws of 2006, No. 90, item 631, as amended), the Participant agrees to the free recording, use, and reproduction of photographs and video recordings made during the training sessions for documentation and promotional purposes, without the need for approval on each occasion. 

This consent is equivalent to the use of photos and recordings with the participant's image in promotional materials and their publication on the Organizer's website (www.maleprzezuwacze.edu.pl) and social media (Facebook, Instagram).

 

§11 Rights and obligations of training participants: 

1. Participants have the right to: 

a) complete the training program in accordance with the previously agreed schedule, 

b) comfortable conditions at the training venue, depending on its specific nature,

c) access to the Closed Training Zone (only if the Organizer provides for its use as part of the training program, course, or video guide),

d) receive training materials in printed or electronic form (only if they are an integral part of the training),

e) a personalized certificate confirming participation in the training (depending on the training, the certificate may be in paper form or sent to the Participant's email address as a .pdf file),

f) the opportunity to express their opinion about the training in an anonymous survey, 

g) withdraw from participation in the training (stationary or online), after prior notification to the Organizer, subject to the provisions of §5 and §6 of these Terms and Conditions for the Provision of Training Services.

2. The participant is obliged to:

a) read these Terms and Conditions for the Provision of Training Services,

b) send the signed Agreement together with the Terms and Conditions of Participation in Training and the signed Declaration of Respect for Intellectual Property Rights and Copyright to the Organizer's email address,

c) pay the training fee within the specified time limit,

d) in the case of online courses and training lasting several weeks, participate in at least 80% of the classes. A participant may be removed from the list of participants, resulting in non-completion of the training (without the possibility of a refund of the fee paid), if they have not participated in at least 80% of the classes,

c) behave in a manner that does not disrupt the training during the training.

 

§12 Personal Data Protection:

1. In accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133 of October 29, 1997, item 833), the Organizer declares that it does not transfer, sell, or lend the collected personal data of users to other persons or institutions. Personal data provided by the Ordering Party shall be treated as highly confidential information and shall be used solely for the purposes of communication between the Ordering Party and the Organizer.

2. The Organizer guarantees that the personal data of training participants will be stored in a manner that ensures their security, solely for communication and organizational purposes. 

3. By participating in the training, participants consent to the processing of their personal data by the Organizer for the purpose of conducting the training.

3. Participants have access to their personal data at any time and have the right to update or delete it. Such a request should be sent to the Organizer by email. 

4. Participants give their consent in accordance with the clause in the application form.

 

§13 Complaints:

1. Each participant has the right to submit complaints regarding training services within 3 working days from the date of completion of the training.

2. Complaints about training services can be submitted electronically to the following address: kontakt@maleprzezuwacze.pl, no later than within 3 working days from the date of completion of the training.

3. A valid complaint should include:

a) The name or first and last name of the Participant;

b) The address of the Participant's registered office or place of residence;

c) The subject of the complaint (name of the service, date and place of performance);

d) Substantive and formal justification for the complaint;

e) The Participant's expectations of the Organizer in terms of compensation.

4. The complaint will be considered within 14 business days from the moment the Organizer receives it by email. In cases where additional actions requiring clarification are necessary, the time for considering the complaint may be extended.

5. The decision regarding the complaint, with a possible proposal for compensation (if the complaint is justified), will be sent by email.

6. The Organizer reserves the right to leave the complaint unconsidered if it is submitted after the deadline referred to in section 1, or if it results from ignorance of the provisions of these Regulations.

7. If the complaint does not contain all the information specified in section 3, the Organizer will give the Ordering Party an additional period of 3 business days to resubmit a correct complaint.

 

§14 Final provisions:

1. The Terms and Conditions shall enter into force on the date of their publication on the Organizer's website and shall remain in force for an indefinite period.

2. In matters not covered by these Terms and Conditions, the provisions of the Civil Code shall apply. 

3. Any disputes arising between the Organizer and a User who is a Consumer shall be settled by the competent common courts in accordance with the provisions of the Code of Civil Procedure.

4. Any disputes arising between the Organizer and a User who is not a Consumer shall be settled by the court competent for the Organizer's registered office.

5. The Organizer reserves the right to amend the Terms and Conditions. Any amendments shall be effective from the date of their publication on the Organizer's website. Agreements signed before the amendments to these Terms and Conditions are introduced shall be performed on the basis of the provisions in force on the date of signing the Agreement.
